U.S. Senate Spy Bill—Locked and Loaded to Shoot Down 1st and 4th Amendments

The U.S. House of Representatives on June 20th, 2008 sent to the U.S. Senate,           THE FISA AMENDMENTS ACT OF 2008, HR 6304.

As most of us know, several Telecoms have gotten caught helping U.S. Spy Agencies—illegally wiretap millions of U.S. and International phone calls, faxes and emails.

Will U.S. Government’s illegal-Wiretaps be made available to U.S. and International Criminal & Civil Courts after HR 6304 is Passed?

Before the U.S. Senate passes THE FISA AMENDMENTS ACT OF 2008, shouldn’t the Senate first disclose to U.S. Citizens what may happen to the Government’s millions of illegally seized Electronic Communications that belong to U.S. Citizens?

Still, Congress hasn’t clarified whether the Bush Administration’s years of illegal wiretaps are admissible into U.S. criminal and civil courts. It is problematic after HR 6304 is passed, that police agencies and private government contractors will want to use illegally collected NSA/FBI and other illegal government wiretap surveillance to go back years to arrest Americans and or civilly forfeit their homes, business assets and inheritances using only a “preponderance of civil evidence” under Title 18 of the United States Code; or under the Patriot Act. There are over 200 U.S. criminal laws, violations and U.S. Government cooperating agreements with other countries that can make property subject to civil asset forfeiture. No one need be charged with a crime for government to civilly forfeit an owner’s home or business.

I hate to say it, but I do believe that this injustice that our US judicial system has been inflicting on the tens of thousands of our Middle Class and Working Poor Amercans (who are the least educated US prison inmates) with prolonged incarceration, is a very realistic human rights violation if not a crime against humanity issue.

The International World Court and United Nations should be investigating why only wealthy Americans are able to receive federal retrials using proper legal representation and US poorer prison inmates are forced to be their own best lawyers from prison and failing in mass at their opportunities for federal retrial reviews.

Our judicial system just recently released 360 men who spent 25 to 40 years being incarcerated for rapes they never committed! Had these judicial victims been given appeal attorneys for their federal appeal reviews, just maybe they might have been given retrials and not have had to wait until DNA evidence exonerated them decades later.

Until our judicial system becomes so perfected to always accurately charge and convict the right individuals with crimes,we all have to stay focused on preserving every legal opportunity for the truly innocent to be able to rise up and out of our cold hearted prison system that treats everyone in their grasp as guilty equals.

It appears that the US Supreme Court way back in 1984 knew the injustice of our federal appeal retrial review process really only being available for affluent Americans to get benefit from.

The masses of poor and mostly uneducated prison inmates who are being forced to write their own federal appeal legal cases, are being denied new trials by the federal courts in mass all across this country everyday.

Some believe this injustice stems way back in our history to pre Civil War era when the US Southern States were railroading blacks into prolonged prison sentences and knowing all along that the Federal Courts would never grant these poor black prison inmates new trials because they never could properly write their own federal appeal legal cases.

The real horror here is that this form of injustice is even in 2008 assisting in the prolonged false incarceration of over 100,000 innocent mostly uneducated American prison inmates nation-wide.

We all know the federal appeal retrial process was designed for all Americans as a fail safe device that every American should be entitled to utilize, but it is quite obvious that our government has allowed this appeal process to slip into a completely new facade in which it has become an exclusive opportunity for only rich Americans to be able to properly benefit from.

Most Americans are well aware that there are plenty of innocent poorer US citizens in our prison systems nationwide,but very few of us have ever heard about our US Congressional representatives who are mostly lawyers themselves, denying our Middle Class and Working Poor Americans proper legal counsel for their federal appeals.
When any poorer American is charged with a Federal crime all legal costs and appeals are paid for,but when one is charged in the various 50 states and run out of higher court state appeal opportunities and need to appeal to the Federal courts,it appears that these poorer and mostly uneducated prison inmates are left to their own best lawyering skills to attempt to write a federal appeal that could sway a US Federal judge to grant them a new retrial.
Our US Congressional Representatives sleep soundly every night knowing there are reported to be an estimated 100,000 innocent Americans (some residing for decades even on death row) in our US Prisons who have been denied proper legal counsel to help them attempt to exonerate themselves with their Federal Appeals?

We Americans should be fed-up and angry as hell!

What has happened to us?  When did we get so weak and detached?

Wake-up, America!

We should be phoning our lawmakers in the Washington and various State Capitols and demanding REAL leadership.

It's obvious by now that there is little leadership and that if we don't rise-up together, united, to find REAL leadership we're going to sink like the Titanic!

George W. Bush gave away America!  He set us up to become 3rd-rate citizens and a meager nation.

Wake-up, America!

George Walker Bush has defiled our Constitution and made us weaker, as a nation, as a people.

You can either think I'm insane or you may quote me, but that man and his assembly of cohorts gave away the America we once were proud of.

His band of know-nothing, do-nothing, bumbling honchos have made our beloved America weaker and more dependent on foreign energy.

Our domestic infrastructures are corroding away, our education system is falling apart, we have fewer good-paying jobs and more home foreclosures than EVER in our nation, and all our president tells us is that "We must stay the course."

Making Sense of Barack Obama, What He Says and the American Dilemma

I need to preface this commentary and say that I have been a member of the Republican Party since the Eisenhower administration of the 1950's.

I need to say that because there will be quite a few folks pointing their fingers and tongues at me as a "Liberal" and that's just not true.

I am just like so many people who are trying to make some sense of the past several decades of Democratic and Republican mismanagement of our nation, and also more or less "soul-searching" and wading through the seemingly endless well-practiced speeches of the candidates of the current presidential "primary", which has evolved into an Ironman marathon of candidate "two-stepping", media rhetoric and political gamesmanship.

Honestly, how the heck can you make any real sense of all this chaos?

I have been forcing myself to listen to the speeches of each of the candidates:  John McCain, Hillary Clinton and Barack Obama.  I have come to some conclusions that some people may or may not agree with, but I have based my presumptions and opinions with careful consideration.

Consequently, it is my opinion that Barack Obama is the more intelligent of the 3 candidates.  Please note that I am NOT stating that he will win come election day or that he is the best candidate for the position.

I simply am saying that Obama is the "brightest" of the bunch.

That said, let's review a few of what Obama and I believe are urgent issues:

  • The war in Iraq
  • Middle East Nations
  • U.S. Budget and Expenditures
  • A Stagnated Congress
  • U.S. Economy / Recession
  • High Cost of Gasoline
  • A National or Socialized Health Care Program
  • Creation of Jobs
  • Education
  • Transportation

5th Anniversary of "Mission Accomplished" in Iraq

Happy 5th Anniversary, America! May 1, 2008 was the 5th anniversary of the day President George Walker Bush, televised from a U.S. Battleship, told the American people that we have completed our mission in Iraq. Five years later there is one thing we do know for sure.  We are still stuck in Iraq and will be for an undetermined length of time.  Since that time another almost 2,000 Americans and Iraqis have died in Iraq.  Many deaths were the "innocents" whose only fault was in living too close among the terrorist fighting population. In addition, the U.S. economy has slipped and fallen into a deep foul-smelling bog, which seemingly is inescapable for most citizens.  We have watched as our leaders continued to cut taxes for the wealthy and increase an astronomical war debt in the middle east.  The American dollar has plummeted in value, while silver, gold and platinum have skyrocketed. During the past 8 years those wealthy individuals and corporate hierarchy close to the Bush administration have raked-in huge profits, but the financial straits of most citizens have dissolved into less earnings and ever-escalating costs of living expenses with increased debt. Home foreclosures are at a record high in the U.S. Unbelievably, the president still wants congress to turn-over BILLIONS more for the Iraq/Afghanistan wars and more BILLIONS to fight hunger around the world. What's wrong with spending BILLIONS here in American first? This is the legacy of the Bush administration.  The last time Americans were that "strung-out" was 39 years ago.

Rising Health Care Costs: the tsunami that never ends

People just can't afford the rising costs of health care!

It's bad enough that most of us know that the health care industry is in it for the profits and it has its "claws firmly into the backs" of our congressional leaders.

It's another thing that fewer Americans can afford the ever-increasing astronomical costs.

Case in point, during the past 5 years Texas insurance premiums jumped 40 percent, which makes the state the 3rd highest in the nation.

Insurance rates have soared 10 times faster than their incomes increased!

You don't have to be Einstein to calculate what that may do to our economy and to people's lives.

According to the Robert Wood Johnson Foundation, its studies show that:

 "The findings show:

o Fewer employees are working in private-sector jobs that offer insurance.
Nationally, 4.1 million fewer people worked in private-sector jobs that offered health insurance in 2005 than in 2001.
o Fewer private-sector businesses offer coverage. 
The number of private-sector employers nationwide who offered health insurance benefits to their employees fell by 30,000 from 2001 to 2005.
o Fewer people have private health insurance coverage.
Americans with private health insurance fell nearly 2.4 million, or 6 percent, from 2001 to 2005.
o More people are uninsured.
According to the latest Census figures, 47 million Americans do not have any health insurance."


It is interesting and disturbing to note that neither state nor federal legislators are moving forward quickly to resolve and/or de-escalate the trend.


Southern Nuclear Company Seeks Early Site Permit for Georgia Power's Two New Nuclear Reactors at Plant Vogtle

The first step Georgia utilities are taking to try to get federal approval to build new nuclear reactors along the Savannah River is to apply for an “early site permit.” If the permit is issued, concerns such as water, land, public health, and safety cannot be brought up again even if we learn new information. For example, the new reactors will require tens of millions of gallons of water above and beyond the tens of millions Vogtle is already pulling from the Savannah River—this issue cannot be revisited again if the “early site permit” is granted. If approved, this permit essentially allows the Southern Company and its utility partners in Georgia to use the permit at any time for up to 20 years in any future applications with the NRC. Together, Atlanta WAND, Blue Ridge Environmental Defense League, Center for a Sustainable Coast, Savannah Riverkeeper, and Southern Alliance for Clean Energy legally challenged the permit.

The Savannah River basin and nearby communities are already suffering; building more nuclear reactors will only make this situation worse. Since the Early Site Permit (ESP) process allows a company to potentially ‘bank’ a site for up to 20 years, the NRC should have to look not only at Georgia ‘today,’ but the Georgia we are likely to live in several decades from now.
